These Terms and Conditions apply to the purchase and use of products and services offered by PILLARIWINE CO., LIMITED through its physical stores, online shop, telephone, and various social media channels. By purchasing or using any products or services through these sales channels, you are deemed to have acknowledged and agreed to the following.
1. General
These Terms and Conditions form a valid and binding agreement between you and PILLARIWINE CO., LIMITED. By using our products or services, you confirm that you are: (1) at least 18 years old; (2) legally able to enter into a binding contract; and (3) not prohibited from receiving services under the laws of Hong Kong SAR or any other applicable jurisdiction.
You agree to purchase and use the products and services offered through the sales channels of PILLARIWINE CO., LIMITED in accordance with these Terms of Service and all applicable laws, rules, and regulations (collectively, the “Laws”). Please note that telephone calls, emails, and other communications between you and PILLARIWINE CO., LIMITED may be recorded.
2. Privacy
Any personal information we collect about you through PILLARIWINE CO., LIMITED will be kept confidential, unless disclosure is required by law or by a judicial or administrative order.
3. Purchases
a. Order Processing
PILLARIWINE CO., LIMITED may, at its sole discretion, choose not to process or may cancel your order in certain circumstances. This may include situations where the product or service you wish to purchase is out of stock, has been mispriced, or where we reasonably suspect fraud or other inappropriate activity. We may also take steps to verify your identity before processing your order. If your order is not processed or is cancelled, you will not be charged, or any amount already charged will be refunded.
b. Product and Service Descriptions
PILLARIWINE CO., LIMITED makes every effort to provide accurate descriptions of the products and services offered through its sales channels. However, we do not guarantee that all descriptions are accurate, complete, current, reliable, or error-free.
c. Pricing Information
PILLARIWINE CO., LIMITED makes every effort to provide accurate pricing information for the products and services offered through its sales channels. However, errors may occur. If a product or service is listed at an incorrect price due to an error, PILLARIWINE CO., LIMITED reserves the right, at its sole discretion, not to process or to cancel any related order. If this happens, we will notify you by email. We also reserve the right to correct any pricing error, including any error in the stated full retail price.
d. Sale Conditions
All sales are subject to final confirmation by PILLARIWINE CO., LIMITED. Orders are confirmed when the invoice is issued. No cancellations will be accepted after confirmation. Prices are subject to change without notice. All wines are offered subject to availability and while stocks last, unless otherwise stated. All goods sold are strictly non-exchangeable and non-refundable. This current list supersedes all previous lists.
If an order is changed after confirmation, the original order will be cancelled and a new order will be opened. The original order will no longer entitle the customer to reserve the goods, and the wines allocated under the original order may be released to another customer waiting for new stock.
4. Breakages / Shortfall
Customers are requested to inspect the goods immediately upon collection or delivery for any damage or shortage. Any claims must be made at the time of delivery; otherwise, any breakage or shortage shall be deemed to have occurred after delivery.
5. Material Adverse Change
PILLARIWINE CO., LIMITED shall not be liable for any failure or delay in performing its obligations to the extent such failure or delay is caused by any event or circumstance beyond its reasonable control, including any material adverse change affecting its business, operations, or ability to supply goods or services.
6. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and PILLARIWINE CO., LIMITED with respect to the matters covered herein, and supersede and merge all prior agreements, letters, proposals, discussions, and other documents relating to such matters. In the event of any conflict, these Terms and Conditions shall prevail.
7. Severability
If any term or provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity of the remaining provisions.
8. Law and Jurisdiction
All transactions contemplated through the sales channels of PILLARIWINE CO., LIMITED shall be governed by and construed in accordance with the substantive laws of Hong Kong SAR, and both parties irrevocably submit to the jurisdiction of the courts of Hong Kong SAR in respect of any action or proceeding relating to such transactions.
9. Payment
The order will remain valid for 7 days from the date of confirmation. If payment is not received within this period, PILLARIWINE CO., LIMITED reserves the right to cancel the order without notice or charge a delay interest of 2% of the sales amount.
10. Unsuccessful Delivery
In the event of unsuccessful delivery due to an incorrect address provided by the customer or insufficient payment (including cash on delivery or cheque on delivery), the customer shall be responsible for redelivery charges of HKD 250 per order. We reserve the right, at our sole discretion, to decline delivery of goods to any customer.
11. Cancellation and storage of goods in exceptional cases
PILLARIWINE CO., LIMITED may, at its sole discretion, take one of the following actions in respect of any wine not collected or delivered within 7 days of purchase, or by any separately agreed deadline, whether agreed verbally or in writing:
(1) cancel the order;
(2) store the goods at a warehouse affiliated with PILLARIWINE CO., LIMITED; or
(3) transfer the purchased goods to a neutral third-party warehouse.
Failure or refusal to collect goods that have already been paid for shall be treated as a waiver of the customer’s right to receive those goods.
1. Order cancellation: no refund will be made.
2. Storage at a warehouse affiliated with PILLARIWINE CO., LIMITED: PILLARIWINE CO., LIMITED may charge a storage fee of HKD 30 per bottle per month. Please note that PILLARIWINE CO., LIMITED does not normally provide storage services, and such services are available only on a case-by-case basis. Storage fees, release fees, and delivery charges from the warehouse to the shop or to the designated delivery address will apply. Purchased goods will not be released or delivered until all applicable charges have been paid in full.
3. Transfer to a neutral third-party warehouse: We will provide the name, location, and contact details of the warehouse. The customer must then arrange collection of the goods and pay all applicable storage, inbound handling, outbound handling, and delivery charges directly to the warehouse. All such charges are determined by the receiving warehouse.
